Information shared by all destinations

Seller and contact

José Luís Santos Monteiro, owner of Montarion Universe, Portuguese tax number NIF 271034378. Address and returns address: Rua Sousa Pinto, 199, 1.º E, 4250-481 Porto, Portugal. Email: montarionuniverse@gmail.com. WhatsApp: +351 969 091 148 (messages only).

Production and delivery times

After payment confirmation, production may take up to 8 calendar days to begin, although a shorter waiting period is normally expected. The Lulu Direct or Cloudprinter production and delivery estimate shown before payment runs from the start of production and does not include these waiting days. The total timeframe is therefore up to 8 calendar days of preparation plus the production and shipping estimate for the selected destination and shipping method. This estimate does not limit statutory rights in case of delay or non-delivery.

Print on demand

Printing a standard book only after an order does not by itself remove the right of withdrawal. The statutory personalised-goods exception applies only where a book is genuinely made to the customer’s specifications or clearly personalised.

Shop, invoicing, printing and shipping

The shop uses Shopify for purchases and Moloni for invoicing. Books are printed and shipped through Lulu Direct or Cloudprinter according to the order and destination. The seller is the owner of Montarion Universe; these providers do not replace the seller’s responsibilities towards consumers.

Order, payment and confirmation

Before confirming a purchase, you can review the book, edition, language, quantity, address, currency, total price, taxes and shipping, correct your information and read these terms. The final order control must make the obligation to pay clear. Available payment methods and the time of charging are shown at checkout. Confirmation identifies the order and agreed terms in a form you can retain; a payment receipt does not replace contractual information. Subsequent changes require agreement and do not reduce statutory rights.

Delivery timeframe and delay

The total timeframe shown before payment includes preparation, production and transport. A timeframe longer than a statutory default requires prior information and agreement; a printing estimate alone is not the total delivery timeframe. If we cannot meet it, we inform you of the situation and applicable rights to agree a new timeframe or cancel with a refund. Silence is not treated as agreement. You may notify withdrawal before receiving the book; if it has not been shipped, there is no book to return.

Contact, complaints and returns

José Luís Santos Monteiro handles purchase support at montarionuniverse@gmail.com or through the contact form, without an account. The form provides a reference and confirmation you can retain. Where applicable e-commerce rules require it, we acknowledge complaints within 48 hours and handle them within the statutory deadline, including the one-month deadline applicable in India. Cancellation and refund rights do not depend on photographs, prior authorisation or complaining to the printer. The seller address is on this page; we arrange seller-paid returns where required. Do not send books directly to the printer without an appropriate return address.

Prices, charges and contract duration

Each purchase covers the selected books and quantities, without a subscription or automatic renewal. Before payment, the currency, total price, applicable taxes, delivery costs and other known charges are shown. If a charge cannot reasonably be calculated in advance, its calculation method and the possibility of that charge are explained. Paid extras require express agreement. The book language is identified separately from the website and contract languages.

Documents and version of the terms

You can open, save and print the conditions and forms for your destination. Individual order confirmation must include the order details and the version of the terms applicable to the contract, in a format you can retain. Later website changes do not retrospectively change your contract. You may request a copy or clarification from the seller without creating an account. An invoice is separate from contractual confirmation.

Applicable law and mandatory rights

The seller being established in Portugal does not remove mandatory protection under the law applicable to your purchase. No term imposes exclusive Portuguese jurisdiction or prevents access to competent authorities and dispute resolution bodies. Where a commercial term conflicts with an applicable mandatory rule, that rule takes priority.

The confirmation of the contract is provided on a durable medium within five days of the contract and at the latest at the time of delivery of the book, with the required information and the withdrawal template.

Withdrawal and returns

For distance purchases covered by Portuguese consumer protection rules, you may notify us of your decision to withdraw without giving a reason within 14 days of receiving the book. Send an unequivocal statement to the email above identifying your order and books, or use the model below. Prior authorisation is not required. Return the book to the address above within 14 days after notifying us. These are separate deadlines: 14 days after receipt to notify withdrawal, then 14 days after that notice to send the book back.

Return costs

For withdrawal due to a change of mind, the customer pays the direct return shipping costs. This does not apply to costs necessary to remedy a lack of conformity, including a wrong, faulty or damaged book; those costs are borne by the seller.

Refunds

Following withdrawal, payments received, including standard delivery costs, are refunded within 14 days of receiving the withdrawal notice. Additional costs for a more expensive delivery method expressly selected by the customer are not refunded. Unless we offer to collect the books, the refund may be withheld until we receive the books or evidence that they have been sent back, whichever occurs first. Inspection of the book’s condition cannot extend the legally permitted withholding period. Refunds use the original payment method unless expressly agreed otherwise, at no cost to the customer. After the refund instruction is issued, funds may take several days to appear in the customer’s balance, depending on the payment method, payment provider and customer’s bank. This processing time does not remove the seller’s statutory obligations.

Legal guarantee and order problems

New physical books covered by Portuguese law have a three-year statutory conformity guarantee from delivery. For a wrong, faulty or damaged book, contact us with your order reference and a description of the problem. Photos may help but are not required to exercise statutory rights. Rights to restoration of conformity and, under the statutory conditions, a price reduction or termination apply. Mandatory rights under the law applicable to the consumer remain unaffected.

Condition of returned books

The customer must take care of the book and package it appropriately for return. Its condition is assessed on receipt. If damage, annotations, torn pages, stains or wear are substantiated and result from handling beyond what is necessary to inspect the book’s nature and characteristics, the customer may be held responsible for the actual diminished value under Article 14 of Portuguese Decree-Law 24/2014. If the book is returned in poor condition due to damage attributable to the customer resulting from excessive handling, reimbursement of the book’s price may be refused in whole or in part, only to the extent legally permitted and corresponding to the actual, substantiated loss in value. Refusal of the entire book-price refund requires a demonstrated total loss of value and legal admissibility of that deduction. The reasons, evidence and calculation are communicated to the customer. This provision does not remove mandatory consumer rights or reimbursement of delivery costs where legally required. No fixed penalties or deductions for mere opening or careful inspection are applied. Customers are not charged for defects or damage for which the seller is legally responsible. This rule does not exclude the right of withdrawal or allow receipt of a returned book to be refused solely because it has diminished in value.

Alternative consumer dispute resolution

Montarion Universe prioritises resolving any problem directly and amicably with the customer and undertakes to assess complaints and seek a solution diligently and in good faith. Customers should contact us using the details on this page, identifying the order, the problem and the remedy requested. Before submitting a complaint to CICAP, consumers must first attempt to resolve the dispute directly with us, as required by that Centre’s procedure. If they receive no response or consider the proposed solution unsatisfactory, they may contact CICAP without our authorisation. For consumer disputes falling within its territorial, subject-matter and monetary jurisdiction, consumers may contact CICAP — Centro de Informação de Consumo e Arbitragem do Porto / Tribunal Arbitral de Consumo. Address: Rua Damião de Góis, 31, Loja 6, 4050-225 Porto. Email: cicap@cicap.pt. Telephone: +351 225 508 349 (Portuguese national landline call). Website: https://cicap.pt. Consumer disputes worth no more than €5,000 are subject to mandatory arbitration or mediation where expressly chosen by the consumer, under the applicable law. Although listing CICAP does not declare full voluntary membership, we favour this route when a solution cannot be reached directly with the customer. We undertake to cooperate in good faith in the legally applicable procedures and always seek an amicable solution through mediation or conciliation, respecting arbitration when legally mandatory or agreed. Seeking a direct resolution does not restrict statutory time limits or the right to use courts, other competent centres or assistance from the European Consumer Centre for cross-border disputes.

Receipt and withdrawal period

In the European Union, the 14-day period starts when you, or a third party you designate other than the carrier, take physical possession of the book. For several books in one order delivered separately, it starts on receipt of the last book; for goods delivered in lots or pieces, on receipt of the last lot or piece. Sending your withdrawal notice before the deadline is sufficient. Statutory extensions and rules on missing information remain applicable.

Transport, loss and damage

For deliveries covered by EU rules, the seller bears the risk of loss or damage until you, or a third party you designate other than the carrier, physically receive the books. If you independently commission a carrier not offered by the seller, the statutory exception transfers the risk when the goods are handed to that carrier. Report loss, damage or non-delivery to the seller; you do not have to resolve the matter exclusively with the printer or carrier.

Late delivery

Unless another timeframe is expressly agreed, books are delivered without undue delay and within 30 days of the contract. If the agreed or statutory timeframe is missed, you may allow an appropriate additional period and terminate the contract if delivery still does not occur. No additional period is needed where the seller refuses delivery or the date is essential under the statutory conditions. Termination for non-delivery entitles you to reimbursement under applicable law.

European Union · other countries

Portugal has its own section. In other EU countries, mandatory consumer rights remain applicable: for distance purchases of standard books, a 14-day withdrawal period and at least two years of statutory protection against non-conformity. National law may provide greater protection. The Portuguese three-year guarantee is not presented as a uniform EU rule.

Returns and refunds in the European Union

For normal books purchased remotely, you can communicate the withdrawal within 14 days of receipt and return within 14 days of communication. No prior authorization is required; you can use the template of this page, the form or an unambiguous statement by email. The mere printing on request of a normal edition does not constitute personalization.

The refund includes received payments and normal delivery, within 14 days from the communication. A delivery supplement chosen by the customer may be excluded under legal terms. When permitted, the seller can wait for the book or the proof of shipment, depending on which occurs first; subsequent check of the status does not extend this limit. In case of change of mind, the customer shall bear the return under the informed terms; in case of non-compliance, the necessary costs shall be borne by the seller. A depreciation can only be considered legally attributable to the handling that is greater than necessary to verify the book.

Complaints, Personal Data and Disputes

Support and complaints are received by José Luís Santos Monteiro, at montarionuniverse@gmail.com or by the form, without creating an account. You can turn to the European Consumer Centre of your country in cross-border disputes and the means of resolution or competent courts. The Complaints Book indicated in the Portuguese section is a mechanism of Portugal. The privacy policy for direct purchases explains the rights under the GDPR and transfers; each sheet identifies the local data protection authority.

Outside the European Union · countries and territories

Each destination outside the EU is listed individually below. Being listed identifies a planned destination; it does not mean purchases are open. EU membership is separate from customs agreements, use of the euro or VAT treatment.

Terms for purchases outside the EU

Statutory rights concerning quality, conformity, safety, delay and non-delivery remain available under applicable law. We do not set a universal three-year statutory guarantee outside Portugal. These terms do not require consumers to complain only in Portugal or waive access to competent authorities and courts.

Printing a standard book on demand is not treated as personalisation. Any limitation for genuinely personalised books depends on applicable law and clear information before purchase. Portuguese rules on diminished value are not automatically applied to international returns.

Before payment, the seller, book, price, delivery cost and total delivery timeframe are displayed. If an order involves importation, charges included in the price and charges potentially payable on arrival will be identified. The destination alone does not determine the printing country or who imports the goods.

Personal data and privacy

The seller is established in Portugal and processes data under the direct-purchase privacy policy. Additional rights under applicable local law remain available. You may exercise your rights by email and contact the competent authority; no purchase is required to contact us. Personal data and privacy →
